Hi there am new here and hope you guys can help me out, I'd really appreciate it. Anyway just yesterday I downloaded 2 movies off from Kick-A. Web. It took them quite a while as the movies are from about two-three years back.
So anyway all was good. Until this morning an email came in about copyright and a notice of unauthorized use of a certain company's property (ParPics). They sent a detailed email and even noted the movie I downloaded. However what's scratching my head is that I downloaded 2 movies and they noticed that I have only downloaded one.
The email is by S.Net and they seek my corporation is ceasing all p2p activities. Is it still safe to DL from torrent?? I really need all the help in the world.
I assume you mean a certain red ISP here? They are known to cooperate with copyright holders rather than protecting the customers' confidentiality.
'The email is by S.Net and they seek my corporation is ceasing all p2p activities' says it all about protecting which party's interest. As for the copyright holders, normally they are not to worry about. They will need to get a court order in Singapore against ur ISP(unless the ISP cooperate w/o one), then a civil suit against you to recover damage. Most in the United States wont bother going to that extent. It is absolutely safe to download from torrents, as long as your ISP protect your ID at all cost against any copyright agents in a court of law based in Singapore. US court orders are useless here. Twshady wrote:Hi there am new here and hope you guys can help me out, I'd really appreciate it. Anyway just yesterday I downloaded 2 movies off from Kick-A. Web.

You should print out the email and go to the nearest police station and tell them you are guilty. If further action is taken against you it could be worse.

US court orders are useless here I think your misguiding people here by saying its ok to break the law.Do note, while you say they usually won't bother doesn't mean they can't. They is always a risk that they will do it.
Try to refresh your memory on the ODEX case if you may. Just in case you had accidentally miss it, there is an FTA between the USA and Singapore, the extend of this FTA covers copyrights items as well.It is absolutely safe to download via torrent if the content is not copyrighted or the rights has been specifically granted for the person to download.
A good example would be a freeware application that has been distributed via torrent. Another good example would be buying a electronic version of an movie from an online authorized distributor that distributes the content via torrent. An ISP can desist the initial request by the police or investigating party to release information. However, if a court warrant has been granted to the police or investigating party, the ISP must comply or itself will be charged under the context of 'Contempt of court'.Having said that, torrenting especially items that one is not entitled to comes with a risk. If one is not able to accept this risk, then don't download those things. This applies not only to torrent but any form of downloads methods and channels. SPF's copyright dept(IRPB) has also 'informed the industry in July 2007 that it would not be taking any action on these complaints and suggested that “collaborative enforcement” was the best form of action. By that, the IPRB meant that the industry should take up private prosecution or civil proceedings.' This means that for personal cases of copyright infringment, the only form of action is via civil actions.
State Property 2002 Torrent Download
Civil actions are rare due to cost involved versus monetary compensation received, and the uncertainly of actually winning the case.Im not encouraging piracy - im just pointing out the limitation for legal action here in the Far East, for TS who is concerned about consequences of his illegal activity. Lawyers are very creative about the words they use to bring charges against someone. You don't even need to lose the case, the moment they bring out a court hearing, if you the defendants cannot afford the lawyer and the case by default goes to the Prosecution or one decided to represent oneself and loss the case, the results is the same. Civil suit only means no jail terms but bankruptcy is a very real thing in Singapore. Being deem bankruptee doesn't mean you don't need to repay the damages awarded and if the US cases is any indication, it will most likely roll up to some insane amount. Thus the only advice is don't download any copyright stuffs unless your willing to take the risk.

Even though it cost some money, at least you did not participate in uploading of content unlike torrents. The ISP have no reasons to co-operate nor terminate users.Forwarding of C&D email is almost free anyway - and does not give away user's info. There are no additional cost involved, but on the other hand, the money from the user still adds to the income of the ISP.Not sure where you all get this sort of impression.
